Case background and investigation

On the evening of October 23, 1989, Carol Stuart, a 30-year-old lawyer who was pregnant with her first child, was shot in the head while sitting in a car in the Mission Hill neighborhood of Boston. According to Boston.com, she and her husband, Charles Stuart, had just left a birthing class. Charles, who had a gunshot wound to the abdomen, called for help and told police that a Black man had forced his way into the car, robbed them and shot them both. NBC News reports that Carol died at the hospital the following morning. Her son was delivered by caesarean section and lived for 17 days.

Charles Stuart's description of the attacker set off a large police operation in Mission Hill. According to NBC News and WBUR, officers stopped and searched many Black men in the neighborhood, even though some investigators had doubts about the husband's account. Two men were publicly linked to the shooting. Alan Swanson was arrested first and then cleared. Willie Bennett was taken into custody afterwards, and in late December 1989 Charles Stuart picked him out as the attacker. Boston.com reports that neither man was ever formally charged with the shooting, although both were named as suspects in news coverage.

The account fell apart at the start of January 1990. According to Wikipedia's summary of contemporary reporting, Charles's brother Matthew Stuart went to Boston homicide detectives on the evening of January 3 and said the carjacking story was untrue. He said he had met his brother in Mission Hill on the night of the shooting and had been handed a bag that contained Carol's handbag, jewellery and a revolver, which he later helped to dispose of. Matthew said he had believed he was helping with an insurance fraud and had not known that Carol would be harmed.

On the morning of January 4, 1990, Charles Stuart left his car on the Tobin Bridge and jumped to his death; his body was recovered the same day. He was never charged or tried, so no court ruled on his guilt, but prosecutors dropped Bennett as a suspect and the authorities have since treated Charles Stuart as the person responsible. Wikipedia states that Matthew Stuart pleaded guilty in November 1992 to obstruction of justice and insurance fraud and received a sentence of three to five years, and that a friend, Jack McMahon, pleaded guilty to being an accessory after the fact. Matthew Stuart was not charged with taking part in the killing.

The case is remembered in Boston mainly for the way the false accusation was handled. In December 2023 the Boston Globe published a long re-investigation alongside an HBO documentary series. On December 20, 2023, Mayor Michelle Wu formally apologized on behalf of the city to Swanson, Bennett and their families, calling what was done to them unjust and racist. In September 2025, according to WBUR, the city paid a settlement of $150,000, with $100,000 going to Bennett and $50,000 to Swanson.
